You DO NOT need to activate the phone to use it. However, you have to keep the sim card that comes with it inside the phone to turn it on. I bought one before to use as an iPod. Unlocking: If wishing to activate cellular service, these devices are locked to work on Straight Talk / Total Wireless prepaid service plans only. They may only be unlocked after 12 months of service on their respective networks and will not work on any other network/provider (such as Verizon, T-Mobile, AT&T. Sprint, Cricket and so on) until unlocked. There are no unlock codes or workarounds available on the market for these devices (i.e. eBay code unlockers, etc.). See Unlock Policy

I bet you have to use it for Straight Talk for at least 3 months before you can request to unlock it.
